Abstract:Disputes over the ownership of frozen embryos have aroused significant controversy in judicial practice, which stems from the legislative gaps in the current legal system regarding their legal attributes and rules for right exercise. China's current laws do not clearly define the legal status of in vitro embryos, resulting in a lack of unified basis for judicial adjudication, prominent problems of inconsistent judicial standards and chaotic application of laws by courts. Combining the judicial divergences and application dilemmas in judicial practice, this paper analyzes the causes, explores the optimized path of legal regulation, and puts forward improvement suggestions: the legal attribute of human frozen embryos as "personality property" should be clarified through legislation or judicial interpretation, and the identification standards in judicial adjudication should be unified, so as to solve the practical problems of inconsistent adjudication standards and lack of basis for dispute resolution, and consolidate the normative foundation for the legal handling of disputes.
