父母为子女婚后购房出资的性质认定与分割规则

摘要：本文围绕父母为子女婚后购房出资的法律性质及其在离婚财产分割中的认定问题展开研究，旨在厘清相关法律适用与司法实践中的争议。文章首先概述了我国现行婚姻法及相关司法解释中关于夫妻共同财产、婚前财产及父母出资购房的规定，构建了分析基础。接着探讨了父母出资行为的法律性质，分析赠与、借款等不同观点的法律适用。随后总结了司法实践中对出资性质认定的差异及原因，指出其难点与争议点。通过分析出资时间、形式、书面协议等因素，探讨了影响出资性质认定的关键因素。进一步分析了房产在离婚时的分割规则，结合案例说明其适用逻辑。通过对典型案例的剖析，总结法院裁判思路及指导意义。针对现有制度的不足，提出完善建议，如强化书面协议、统一裁判标准等。结论认为，应通过明确出资意图、完善法律规范，实现公平合理的财产分配。
